Public law Essay Example | Topics and Well Written Essays - 1500 words

Public law - Essay Example This right represents entitlements of an individual or groups visa-vis the government, in addition to responsibilities of an individual and authorities in the government. These kinds of rights are ascribed naturally (Bernan, 2008). Usually, these rights are advanced as legal rights in most constitutions and are secured by the rule of law. The right to protest however in the United Kingdom’s constitution is separate from and prior to law, and is used as a basis for formulating or criticizing both local and international law (Bernan, 2008). Even though various basic rights like the right to protest in the streets should be provided with sufficient protection under any circumstances since there is provision of this. This is provided for in international human rights records like the International Covenant on Civil and Political Rights among others. However, whatever this merits in collaboration with the other UK constitutional arrangement aspects, flexibility has been proven to b e problematic where the fundamental individual liberties are concerned. The imprecision attending flexibility in the UK constitution has left its citizens uncertain regarding the disposition and limitations of the rights they have and regarding their relationship with state institutions. In short, rights such us the right to protest in the United Kingdom constitution are residual in that they exist to the extent that statutory or common law rules have not restricted them (Bernan, 2008). 2. The rights protected by The European Convention of Human Rights. This convention clearly postulates several freedoms and rights such us the right to life, prohibition of torture, prohibition of slavery and forced labor, right to liberty and security, right to an impartial trial, no punishment without law, right to respect for private and family life, freedom of belief, freedom of expression, freedom of assembly and association, right to marry, right to an effective remedy and prohibition of discri mination. Parties undertook to ensure that these rights and freedoms are equally secured to everyone within their jurisdiction. International enforcement machinery is also established by the convention. The European Court of Human Rights in Strasbourg was set up to make certain that the observances of the engagements are undertaken by the parties also dealing with individual and inter-state petitions. The Court has the mandate to give advisory opinions pertaining to the interpretation of the conventions and the protocols thereto as requested by the Committee of Ministers of the Council of Europe (Delmas-Marty, 1992). The control machinery which was set up by the convention has undergone some restructuring as a result of the entry into force of Protocol No. 11 to the convention on 1st November, 1998. Following this, all suspected violations of human rights are directly referred to the court. Usually, during the cases, the Court sits in Chambers of seven judges. It determines the acce ptability and merits of submissions and undertakes an investigation if necessary. With a view to safeguarding a friendly settlement of the matter based on respect for human rights as stipulated in the Convention and the protocols thereto, the Court will also put itself at the disposal of the parties. Court hearings are public unless the Court decides otherwise in situations of circumstances regarded as exceptional (Delmas-Marty, 1992). 3. The human rights act 1998 and the way in which the rights protecte

War on Terror Essay Example for Free

War on Terror Essay If I was the president of the United States in the present times I would use a very different approach in addressing the issue on war and terror. The phrase â€Å"war on terror† is not often used since America cannot win terrorism by the use of military means alone as terrorism is not against an organized enemy who has set out clear identities and has a set of objectives that are coherent. I will cautiously handle the issue with one thing in mind that the war on terror will not be resolved with an overwhelming single blow but this war will demand international cooperation and extreme patience. It would be my duty as the president of the United States of America to ensure that war on terror is not misguided and I would take the holistic approach in addressing the issue on war on terror as the emphasis today seems to be directed on the shutting down of the Al Qaeda cells in existence. I have a very strong believe that terrorist threats must be taken seriously and as a country we would not have any choice but to increase our investments in countering terrorism. As the president I would also make an effective responsive in relation to the modern day terrorism and not just concentrate on enhancing our capabilities on counter terrorism but also I would ensure that that as a country we are prepared to face up to the mistakes we have made in the past. I would use the holistic approach in approaching the issue on war on terrorism. My approach to war on terror In the holistic approach to war on terror I would mainly focus on the 3Dapproach which entails diplomacy, defence and development in pursuit of security objectives of America as a country. This approach will be designed as a strategy which will build its victory’s on the long term, medium term and even short term. I would initially fully embark on diplomacy and encourage peaceful negotiations with the relevant parties through an open discussion or dialogue. If this fails I will the further employ the defensive measures that will ensure the security and also the safety of my country’s citizens. I will take all the necessary measures and prepare my country such that incase of any form of attack my country will be ready to counter the same attack accordingly. I will then employ all the security measures as I ensure that the country’s security is not threatened at any given point. Personally as the president of the American people I would also make efforts in ensuring that there are very effective defenses against any international terrorism especially if it is targeting my country. After which I will focus on those particular countries that which harbors and host individuals and even groups that advocate, finance or even arm these groups thus supporting terrorism instead of stopping it. Also as the American president I would fully pursue the whole-of-system approach in handling the issue on terror which promotes democracy, the human rights and the rule of law and also good governance. To begin with I would establish democratic practices and institutions civil liberties and also political freedom to all the American citizens. I would also unsure that I rule with justice and exercise my power as the president with a lot of democracy. Similarly I would ensure that my government is not authoritarian since authoritative governments provoke a lot of grievances which buds regimes that are safety valves for all the collective anger. After the September 11th attack in America I would have declared the war on terrorism and the battle fields of this war would extend to wherever the terrorists run hide or even plan. Fighting terrorism in a fully democratic country like America has been and will always be a challenge since the actions taken by the American government on countering terrorism may be perceived differently by the public in general who would view it as an infringement on their human rights. I would also tighten the country’s security at the border points, the air ports, the ports and any entry points to the American land. I would be very strategic in presenting my plan to the congress so that I would get support from the majority of members of the house. Conclusion I will prepare a proposal plan which will effectively and strategically address the threatening issue. First of all, I will make it clear that as a nation whether we get involved in solving longstanding conflicts or we don’t involve ourselves at all we will still attract anger other nations who are not our allies. I will present a proposal that will encompass the diplomatic actions that we as a country should take in dealing with war on terror. Similarly the proposal will also outline the ways in which as a country we will defend ourselves in case of any form of attack from the terrorists and also how we will handle any terrorist threats. (Chasdi, 2002) In my proposal I will greatly emphasize on dialogue among civilizations which will further help in promoting the intercultural harmony and further diffuse the terrorism based on hate. I would also put across the fact that as a super power America needs both the military and police actions in combating the threat of terrorism internationally. The key points in my proposal would be the strengthening of the defensive shields that are territorial by the establishment of the multi yard system. I will also emphasize on the fact that the country’s improvement on its intelligence capabilities which is a major force multiplier. Reference Chasdi, R. Murder of Chandra Levy

Murder of Chandra Levy During the summer of 2001, the scandalous murder of twenty-four year old D.C intern, Chandra Levy, had been plastered all over the media. Levys 2001 disappearance formed into a national sensation, after the California native was romantically connected with former congressional representative Gary Condit. The Levy murder, after sixteen years, still remains as Washingtons most famous unsolved crime. There were very few people involved in the proposed scandal. One of the main individuals involved was congressman Gary Condit, a conservative Democrat. He was inconclusively linked to the disappearance of a federal intern, Chandra Levy. It is rumored the two were romantically involved, but Condit stuck heavily with his decision to not verify if this is true. Chandra Levy, native of Modesto, California was an intelligent being, who had a dream to save the world. She was known as a thrill seeker and wanted to become a modern version of Mata Hari, a WWI spy who infiltrated high levels of military commands. She graduated from the University of Southern California with a Masters degree in Public Administration. After interning for a few government members, she learned about the private world of high level politicians who had secret sex lives, Gary Condit for example. She was intrigued by this information, and could easily use her information to her advantage. The scandal between the notable congressman and the intern, was getting a lot of heat, tensions were on the rise. Rumors of Condits tenacious sexual appetite, and how Levy had been done away with, whether it was directly addressed or not by Condit, it is still a mystery. Their relationship could ruin his career and family. However, there are many different theories and versions of what actually happened between the two, although the facts tell the truth. Levy, was secretively an agent of an Israeli spy team called the MOSSAD that sees great importance of their relationships with the U.S, and would be unable to exist, without large amounts of help. The agency is dependent on critical intelligence information that is obtained through cooperation and or secretly. Levy was in the perfect position to gather top secret information, through her position of work and by using her female power of persuasion. Condit, being the senior member of the intelligence committee made him a prime target for such an operation. The seduction of such powerful government officials, provides foreign powers the added advantage of being able to bribe and control the unsuspecting targeted victims to acquire wanted information. After more than 14 months of investigation, Chandra Levys skull had mysteriously been found in Washingtons Rock Creek Park. on May 22st 2002 Although most of the incriminating evidence had been long gone due to the effects of time, it was clear that this was not an accident and had been declared a homicide. Ingmar Guandique, an illegal immigrant from El Salvador, was pinned as the murderer of Levy, all evidence pointed in his direction. Federal prosecutors could no longer prove a case against Guandique. The U.S. attorneys office of Washington concluded that it can no longer prove the murder case against Mr. Guandique beyond a reasonable doubt. (Hounding Gary Condit). The beginning and end of Condit and Levys scandal, took place from May of 2000 up until her disappearance on May 1st of 2001. All of the focus and attention this scandal received, had soon came crashing down along with the September 11, 2001 terrorist attacks. In March of 2002, Condit lost his bid for re-election, mostly because of his ties to the scandal, making this his first time ever losing an election. While the country was focusing on the scandal, the U.S and British forces had started war with Afghanistan. Lasting over thirteen years. There were enough surrounding events during the time of this case that could become more important to the public. Although Condit was never considered a suspect, rumors had circulated and had never been proven. There was no significant proof that he was involved in the disappearance and murder of Levy, which raised more than a few major red flags. Condit had been subject to a poly graph test at the request of Levys parents Robert and Susan Levy, after sources revealed that Condit admitted to having an affair with the intern. Although he failed to answer key questions it didnt effect the results. There was speculation that his results were tampered with. Andrew Schapiro, New York criminal defense lawyer mentioned that such friendly tests, only requiring three questions, arent considered reliable. Condits refusal to play by the new behavioral rules for public officials. Public officials must go through human ethics training it is an instrument for building integrity in state institutions and making sure there is a noble worth of governance. (What REALLY Happened To Chandra Levy). An online magazine writer, Mikey Kaus suggested that if Condit was normal, smart and aware of the rules of engagement (created in response to the Lewinsky-Clinton scandal) then he would have held a press conference the first week Levy was missing, admitted to having an affair with her, and would say that he was terribly sorry and didnt do anything to harm her. Since this is not what happened, he had been put in the impossible position of trying to establish his own innocence without the media being his ally. The government was not directly affected by this scandal, although small pieces within it were. The complicated and mysterious situation had affected the justice and equity and a sort of closure within Levy and Condits relationship. The laxity of the law enforcement system had been compromised. Since Condit had lost the chance of re-election, all of his campaign money was wasted, but the government did not suffer as much as it could have. Surprisingly, many people were effected by the events, and chilling facts of this case. Chandras parents and family were the most affected, losing a beloved daughter who had such a successful and happy life ahead of her. Soon after Levy had disappeared, her home town of Modesto, California and the Levy family had arranged a memorial for their daughter. A turn-out of twelve-hundred people had shown up to pay their respects to the young intern. Condits career and family life had suffered a large blow, but he was a protected person that could eventually rebuild his life unlike the Levy family, they will never be able to do. There is no perfect outcome from this tragic scandal, there is little justice for Chandra and her family. The conviction of Chandras supposed killer, was clearly made by weak assumptions and deceptive evidence. Ingmar Guandigue had not been convicted for the murder of Levy but had been sentenced for other criminal attacks on women. Condit had preserved his innocence and has been protected from ever being seen as the real villain. The defense attorney who worked on the case, had stated that Condit acted like a guilty man and received special treatment after authorities had ruled him out of being a suspect. Fifteen years following her murder, Condit had published a book called Actual Malice describing the unfortunate events that had occurred during his time knowing and being involved with Levy but also his side of the story. Gary had issued a statement through his lawyer saying that he was disappointed in the dismissal of his involvement in the case. The failure of authorities to bring formal closure to this tragedy after fifteen years is very disappointing but in no way alters the fact that Mr. Condit was long ago exonerated by authorities.Although he has had plenty enough media time to prove his innocence, millions of people whole-heartedly believe that Condit is completely guilty. The national sensation, although unfortunate, had gained millions of questions, and more than enough attention. Government scandals always seem to be covered up somehow, the truth is twisted to preserve ones innocence. Chandra Ann Levy, was someone who could change our world and create a safer place for our future children, her untimely death has made a numerous amount of people open their eyes to much more than what is put in front of them. Levys story, and even her murder has proven that no matter how intelligent, beautiful, and protected people can be manipulated in ways that can end their life.

Tobacco Companies Targeting Young People :: Free Essay Writer

Tobacco Companies Targeting Young People Thesis: Statistics show us that young people are the main target of the tobacco companies. Outline I. Introduction II. Two main companies III. Tobacco industries claims VI. Other problems V. Stopping them from smoking VI. Conclusion Every day, 3,000 kids start smoking, most of them between the ages of 10 and 18. These kids add up to 90 percent of all new smokers (Roberts 38). These statistics show us that young people are the main targets of the tobacco companies. The cigarette manufacturers will deny it, but advertising and promotion play a very important part in making these statistics a reality. The two main companies in this advertising war are Marlboro and Camel. Marlboro uses a western cowboy called the Marlboro Man, while Camel uses Joe Camel, a hip cartoon character. Everywhere you go there is billboards or some other kind of advertisement on these two shady characters. When I say shady, I imply that these characters are not just figures we see but they are traps just waiting to lure the next victim in. As kids look through magazines and see Joe Camel driving a cool car and surrounded by beautiful women they get the idea that in order to be somebody they need to smoke a Camel cigarette. It is not right to prey on young people just because they are unaware of the dangers of smoking. The tobacco industry denies that these symbols target people less than 21 and claim that their advertising goal is simply to promote brand switching and loyalty. Many people disagree with this statement such as Illinois Rep. Richard Durbin who said "If we can reduce the number of young smokers, the tobacco companies will be in trouble and they know it"(Roberts 38). The problem we are facing is not only with the tobacco companies but with the young people also. The reason why I say this is because most youths know that they are being targeted. If these kids realize that the advertising is manipulating them, why do they still smoke? The ads reflect an image of rebellion and fitting in. These are all the things a young person, between childhood and adolescence, needs and desires. This type of advertising, on top of peer pressure, is the mystery behind the rise in adolescent smoking. How do we stop the future of America from smoking? Here are three things that the experts recommend. Try to convince your children that smoking is not cool. Talk to your kids at a young age about the dangers of smoking. Identify family members who smoke and ask them to stop (Thomas 450).

Effective Broadcasting of Channel One

There is a large debate erupting within our nation†s education system. Corporate America is invading our classrooms and campuses at an alarming rate. Corporate conglomerates such as Coca-Cola, Pepsi, Nike, and US West are making their presence felt in the hallways, gyms and classrooms from grade schools to colleges. Should these companies be allowed to buy their way into the classroom? The answer is no. Corporate restructuring of our educational systems is not the way to solve our schools† funding problems. Big companies want to get into the classrooms as soon as possible. Next year, 53 million American children will make up approximately $250 billion dollars worth of immediate spending (Long, 2000:1). If the children are properly marketed, this figure would rise exponentially in later years, leading to a lifetime of brand recognition. These children are beginning to associate certain products with the brand names that they see and use at school every day. This will then likely cause these children to continue to buy the same products later in life as well. This lifetime of purchasing power could lead to incalculable profits in future years. Channel One is a daily newscast that is offered to students around the country. Nearly 40 percent of American schools tune into Channel One everyday (Manning, 1999:1). A controversial entrepreneur, Chris Whittle, founded this company in 1989. These students are supposedly tuning into this program every day in order to keep up on current events and issues around the world. However, Channel One is now known as the most profitable in-school marketing campaign in the nation. The company gives the schools, which will allot time for students to watch the program, free satellites and television sets. What it also gives them is two minutes of paid advertising (Stark, 2000;1). Nearly all of the 86,000 schools across the country use some sort of program where the schools receive money or equipment in exchange for proof-of-purchase coupons or receipts (McQueen, 2000:2). Is our public education system nothing more than an incentive based purchasing program, or are we trying to teach independent thought and creative thinking? Third grade math is being taught by using â€Å"Tootsie Rolls. † Classroom business courses are being taught by touring students through McDonald†s facilities. Coca-Cola and Pepsi are feuding over multi-million dollar contracts that would ensure student consumption of their products first (Manning, 1999:1). Nike offers free apparel and equipment for sports programs, only if the athletes will become walking billboards, wearing large logos on their jerseys and clothing. US West builds team scoreboards only for schools that will agree to exclusive vending deals. However, there is something else to be said about the commercialism of our nation†s public education system. In standardized testing, our nation†s education system is falling behind the rest of the world. The government has been lagging on education reform, and fewer dollars are being pumped into most areas of public education. Some would say that commercialism is a great opportunity to put money back into the schools. South Fork Highschool In Marlin County, Florida gave Pepsi the exclusive right to to market and sell its beverages to their students in exchange for $155,000 (Stark, 2000:3). A school that was in dire need of funding received compensation and Pepsi, in turn, gets to be the sole distributor of beverages to the school. This is the business exchange. These companies will provide money and services for schools that are lacking proper funding in exchange for what is turning out to be rudimentary corporate brainwashing. This may not be necessarily bad for the students, but it does pose a threat to true consumerism. Another great example of this is The Wal-Mart Corporation. More than 1,800 Teacher of the Year awards are given by Wal-Mart, each teacher receiving $500 that can be turned around and spend at Wal-Mart to purchase goods and supplies for the class (Long, 2000:2). This is where Wal-Mart†s investment begins to pay off. When the students see that Wal-Mart has recognized a teacher of theirs, and has in turn given money for the school, than the students will begin to see Wal-Mart as a good company. This may, in-turn, cause sub-conscious purchase intent in the future for these students. While this may seem like a fair trade, money in exchange for consideration, but there is a deeper issue at bay. Should this potential corporate brainwashing be allowed to occur when our children†s susceptible minds are at risk? If this is allowed to happen, then our entire society could be interpreted as being one large marketplace, where commercialism dominates over everything, even basic public education. There are some people who are fighting back against the onslaught of corporate propaganda, and it can make a difference. A group in Seattle, known as the Citizen†s Campaign for Commercial-free schools (CCC), has been organizing meetings and â€Å"commercialism walk-throughs† in order to raise public awareness of the situation (Manning, 1999:3). In these walk-throughs, groups from the CCC will go and collect as much marketing material in the schools as they can, and send copies of their reports to the appropriate school boards. One schoolboard, with pressure from the CCC and other supporters, issued a resolution stating â€Å"We are opposed to exposing schoolchildren to corporate values in an educational environment where they assume that whatever is presented to them carries the approval of the educational establishment (Manning, 1999:3). After this resolution was issued, members of the CCC were put on a school-community task force responsible for studying the issue and making policy recommendations. Four states have also begun to limit certain types of advertising and other commercial activity from their public schools: California, Florida, New York, Maine, and Illinois (McQueen, 2000:1). According to the Center for Commercial-Free Public Education in Oakland, the Madison School Board in Wisconsin was the first ever to reject renewal of an existing corporate contract when they cancelled their contract with Coca-Cola after months of public debate (McQueen, 2000:2). In closing, it is imperative that this corporate desecration of our education system be stopped now. If this problem is not remedied, then businesses could quite feasibly end up running our public education. People are making a stand, but the results are too far and in-between for any real difference to be seen. Consumerism will eventually take the place of learning as the goal of our schools, and we will fall further behind in terms of international education standards.

The New U.S. Meat Industry essays

The New U.S. Meat Industry essays The new U.S. meat industry of food retailers, meat processors, and farms and ranches coalesce into fewer and larger businesses are emerging. These new giants like Wal-Mart could drive up food prices for consumers and drive down livestock prices for consumers and drive down livestock prices for producers. Grocery stores have merged or acquired other stores, spawning several major grocery chains and large general merchandise stores and warehouse clubs have appeared on the retail scene. While market power seems to be uprising public policy ensures that all participants will benefit from the new structure. With this new structure the number of meat processing firms has dwindled rapidly, boosting the market share held by the industrys largest players while the number of slaughter plants have plunged. Food demand and technology are the two forces of the meat industrys transformation to a more compact structure. Consumers are looking for food that is easy to prepare while also promising safe eating, improved nutrition, and greater consistency. The U.S. food market is notoriously slow growing with food spending rising more slowly than consumer incomes. Consumers are buying more conveniently prepared food products of consistent quality, despite the sluggish growth of over all food spending. With increased consumption from poultry profit margins in the beef and pork processing industries tightened. Meat is the single largest expenditure item in the consumer grocery cart, and livestock represents the single biggest item on U.S. agricultures income statement. The Sherman Antitrust Act, the Clayton Act, and the Federal Trade Commission Act express the nations commitment to a free market economy where competition benefits both consumer and businesses. This new structure should reflect these laws and expectations that benefit all participants. ...
